Terms of Use

Website terms of use

These Terms are part of the Adynamite platform agreement governing access to and use of the service provided by Adynamite LLC.

By opening an account or otherwise using the service, the customer affirms consent to these Terms.

If a customer acts on behalf of a corporate entity or third party, the customer represents that they have authority to bind that entity or party.

Definitions

The current live terms define key concepts including Affiliate, Ad Account, Master Account, Ad Network, Ad Spend, Platform, Intellectual Property Rights, Service, Order Form, and Term.

The Service means the platform available as software as a service for online management, monitoring, execution, and optimization of marketing campaigns and related activities.

License and use of service

The service is intended to assist with creation, management, monitoring, execution, and optimization of advertising campaigns on applicable ad networks. It does not replace customer discretion.

Marketing effectiveness depends on third-party ad networks, product quality, compliance, and selected strategies. Adynamite does not guarantee campaign results, profit, or that outcomes will meet expectations.

The platform and service may be used only for the agreed purpose and may not be copied, distributed, sold, licensed, exploited, reverse engineered, or used outside the Terms without written consent.

Registration and account access

Access to the platform requires customer registration and account setup. Customers are responsible for linked ad accounts and may add or remove accounts as allowed.

The platform may offer a free trial period. Subscription does not continue after the trial unless payment is made, and unused trial time is not refunded.

Credentials are confidential and personal. Additional users may be added by the customer, and the customer remains responsible for their compliance.

Intellectual property and third-party services

Adynamite retains all proprietary and intellectual property rights in the service, platform, documentation, and related technology.

Customer-created content remains the customer's property, while feedback relating to the platform or service may be treated as Adynamite property.

Third-party services and ad networks are governed by their own terms. Adynamite disclaims responsibility for third-party websites, platforms, rules, functionality, and changes.

Fees and commercial terms

Fees may depend on ad spend associated with the customer's account. If actual spend exceeds the selected package or order form, excess charges may apply.

Rates may be amended from time to time, and sales tax or VAT may be added where applicable.

Additional services may be offered and may be subject to additional fees.

Representations, confidentiality, and compliance

Customers represent that they have authority to accept the Terms, will use the service lawfully, and will comply with applicable ad network rules.

Information provided by Adynamite or included in the service, except customer-generated content and customer activity reports, is confidential.

Warranty, support, and liability

The service is provided as is and as available, without warranty. Adynamite does not guarantee uninterrupted or error-free operation.

Adynamite does not assume liability for interruption, failure, damage, or liability caused by third-party ad networks, data providers, platforms, or websites.

Liability limitations and support terms follow the current live Terms of Use and any applicable order form.

Term, termination, and data use

Subscriptions may be terminated according to the platform settings and applicable order form. Adynamite may suspend or terminate access for breach, network violations, or other reasons described in the Terms.

Adynamite may collect, retain, store, transfer, and use service usage data for fees, coverage analysis, monitoring, service improvement, product learning, benchmark insights, and aggregate reporting, including anonymized or aggregated use.

By using the service, customers agree that anonymized or aggregated data may be used by default for benchmarks, product learning, service improvement, and aggregate insights. Customers can opt out in Settings, after which Adynamite stops adding new eligible data from that user to future benchmark and product-learning datasets. Previously aggregated or anonymized information may remain because it no longer identifies the customer, user, workspace, or account.

For Google user data, Adynamite continues to follow Google API Services User Data Policy and Limited Use requirements, including the commitment not to use Google user data to train generalized AI or machine-learning models.

General provisions and contact

The Terms may be updated from time to time. Continued use of the platform and services constitutes acknowledgement and consent to amended Terms.
